Fiance K-1 visa Process checklist 2021

It can get hard to track your progress through the Fiance(e) K-1 process.  I mean, there are so many steps and requirements each leg of the journey.

That’s why it’s important to keep a running checklist.  With that, not only will you follow what’s going on, but it’s going to keep you aware of what’s in the near future.

Although each case is unique and not processed the same way, this free K-1 checklist will help you keep account of the main steps. It also serves as a quick reference when you’re trying to remember the specific dates, times or case numbers.

    When you’re submitting photo evidence does everything have to be printed or will a USB work?

      Thanks for getting in touch. The USCIS won’t accept anything that is not printed. A USB is a not acceptable when it comes to assembling your packet. You will have to print everything on paper.     Hi Prem! Thank you for sharing all these information. Btw, I would like to know. What if the petitioner lives with his parents but they are not dependent of him. Are we going to follow the income requirement for a household or two (petitioner and beneficiary) or need to comply with the household of four (with parents)? Thank you so much in advance!

      Hello Janine,
      the household size is a combination of different factors and people who are dependents. If your partner lives with his parents but they’re not dependent on his tax returns or otherwise, then they probably don’t count as household members from what you’ve said. I’m assuming you’re asking this for the I-134 Affidavit of Support. However, if you’re referring to the I-944, then the situations becomes slightly more complex.

    Hi Prem & team,

    We got I129f approval recently.
    I was going to through packet 4( Mumbai Embassy)
    there is a checkbox

    MARRIAGE CERTIFICATE:
    “If you have ever been married, bring your original marriage
    certificate, as well as a clear photocopy. If it is in any language other than English, bring a
    notarized English translation”

    Does it mean that do we need to have original Marriage certificate of previous marriage? we usually get rid of everything related to ex.

      Pam,
      Many times the consulate uses generic instructions for K visas as for the spousal visa. So, many times they’ll ask for documents that don’t apply. Marriage certificates are usually one of those documents that Embassies say you should bring in, but what they really want from K visa applicants is the divorce document.     hey there, ive been living in Singapore for 4 and half years, Taiwan for almost 8 years, do I have to apply police certificate to both countries ive been living before? ive looked out for that in the internet seems like possible to apply the police certificates while im not there anymore. please respond me asap, its emergency

      Sara, we do appreciate your contacting us.
      You are supposed to present Police Clearance Certificate for each place you have lived for more than 6 months.
      Our advice is that you check the civil reciprocity tables to make sure whether a PCC is really needed or not. Some countries allow a waiver for PCC. Please check the table and plan accordingly.

    Hi Prem,
    I’m wondering ask a question about what documents should i sent to USCIS ?
    I already prepared Form I-129,Proof of citizenship, Intent to marry, Proof of relationship,me and my fiancé ’s passport style photo . Did I miss any document?
    and I’ve another question..
    I know that my fiancé and I need to get married within 90 days after I entering the United States, but when I get the visa, is there a rule on how long do I need to enter the United States?(I mean Is there a time limit for K1-visa? ) Because we plan to get married on 2021 January. but we plan to sent our petition in this month, is it too early to sent?

      Hello Sherry,
      Thanks for reaching out. After the K1 Visa is issued, it’s valid for up to 6 months. The validity will also depend on the medical examination results.
      The whole process between filing the petition, being approved and scheduling the medical examination and the interview with the Embassy may take up to 10 months (with no RFE) give or take. I recommend you read up on the timeline here:

      By organizing everything and forwarding a strong bona fide packet, you may be able to follow your plan of getting married on January 2021.

      However, bear in mind that if you want to delay your visa process there are many ways to do that and you’re not required to apply for a visa immediately even if your I-129F is approved. We’ve prepared a great timeline page to help applicants figure out when the best time for filing is.
