Lot’s of blanks in your I-129F form?

Some petitioners get worried about leaving spaces blank, or ask “what do I write if it doesn’t apply to me?”. The USCIS’s instructions for the I-129F itself will tell you how to fill out the form with a good walk through. 

Quite frankly, much of your petition may look empty. For most Fiance visa cases, the petition has extra space for different circumstances. But for most petitioners, it seems like the I-129F petition will have many empty boxes.

Don’t worry, it’s normal. 

The attached I-129F filled out example is a model of how an ordinary situation may look like for a fiance(e) K-1 visa petition.

What’s in the I-129F Sample form

The entire form’s information is filled out, along with a typical generic address. Let’s assume the petitioner is a divorced male from New York City. He has no young children. He’s filing for his fiancee in Brazil. She is single and has no child.

This is an example of how a filled out I-129F sample form looks for the fiance k1 visa

Within in this example I-129f petition, we understand that the foreign fiancee has never previously visited the US and intends to live with her fiance after marriage. 

In order to solidify their case, the petitioner has included a supplemental question 54 “circumstances under which you met”.

The petitioning fiance has no criminal history and has never filed filed a previous I-129F (or any other petition for that matter). Since this form is self-filed, there is no need to complete parts 6, 7, and 8.

    Hi,
    I would like to know some info about the DS-160 form. As a part of an abroad program at my uni 6 years ago, I studied in Germany for 12 months and found myself a part-time job there while studying. Do I also need to submit criminal record from Germany as DS-160 says for countries lived in for more than 6 months since it is not my homecountry? Thank you, Marie

    I am the American citizen, and I’m wondering what documents I need to include for my fiance for the i129f – do I need to include his birth certificate, passport pic, proof of clean record etc with the initial i129f? Thank you in advance.

      You will find the exact requirements in our I-129F checklist. You can scroll down to sign up for it and you’ll get a 14-point checklist to understand what parts are required. IN general, a birth certificate of the foreign partner is not required unless you need to show some sort of proof of legal name change.

    Hello Mr. Prem,

    I am the petitioner. Does my fiancé need to mail me an original copy of his Letter of Intent to Marry and the K-1 Declaration with wet signatures (before I file the application package) or can he send me his copies electronically with a DocuSign? I will provide mine with a wet signature but I was wondering if he can send his copy to me electronically signed by DocuSign?

      The Letter of intent to marry doesn’t have to have a wet signature. As per USCIS signature policy, you can submit a photocopied version of the signed document as long as you possess the original yourself.     Hi! My fiance is filing the I-129F and have a question for the part 4.a. Basically he was a mischievous teenager (ages 12-14) and got in trouble a couple of times and charged with misdemeanor as a minor , never convicted or fined though. He has a clean record now, is this something that should be disclosed?

      When it comes to any criminal background, we recommend that the parts involved seek legal advice.
      By reading USCIS Form F-129F’s instructions you find some of the listed crimes that need to be disclosed even if the case has been expunged or cleared.

    Hello,

    My fiance has visited and lived in the US for about a year about 8 years ago but does not currently live in the US. In this case, will I have to fill out Part 2 Items 38.a-38.h? The instruction says “If your beneficiary is currently in the United States, complete Item Numbers 38.a. – 38.h.” Do I still need to fill it out?

    I have known my fiancee all my life. but I haven’t seen him for six years but we have been communicating all this time. We finally decide to marry. Do I have to go see him in Trinidad to satisfy the within 2 years last seen, or can I just go ahead and file a k-1 petition here in the US? Thank you for a reply. And another thing, can his daughter fill the affadavit of support since my income is too small? Thanks you for a reply.

      Unless your fiancee’s religion (and this has to be proved) prevents you from spending time with her before marriage, it’s mandatory to meet the 2-year prior to filing meeting criteria.

    Hi Prem,
    The current I-129F instructions says to fill out any field not applicable to you with N/A (or None for numerical responses). The PDF form does not allow you to put those in as instructions request. So is it Blank or N/A? I will have to handwrite a lot of N/As…

      That’s right. The instructions and the PDF don’t work together too well. I’ve noted this, and several more mistakes in my post here: https://www.visatutor.com/form-i-129f-petition-mistakes/
      In general, you can handwrite the “n/a” or “none”, or do as I do and leave it blank. So far, this hasn’t caused any problems with my students in the courses.

    on page 13 of the 1-129 form for additional info, my fiancée has had other names, my question is this, numbers 1a-1c would be her name since the info is about her, or my name since I am the petitioner? thanks for your help, joe smith

      Hello Joe,
      This item you referred to on page 13 is automatically populated (if filled out in a computer), thus, that would be your name, the petitioner.
      However, if your fiancée has had other names, you must fill out her extra names on any of the spaces starting on item 3a on the very same page.
      Page 13, which is part 8, is for those extra entries where you didn’t have space for in other questions.

    Dear Prem,

    Me (citizen of Poland living in the UK for the last 13 years) and my fiancee (Naturalised American citizen) are in the process of gathering documents for our Alien Fiancee Visa application.

    I have few questions and would be grateful if you can answer.

    – I am currently in process of obtaining British Citizenship. Is it going to complicate things?

    – Am I going to be interviewed in the UK or Poland?

    – My first name is Malgorzata but in Polish it is shortened to Gosia which I am called by my fiancee, family and friends by. It is still the same name as there are many different variations and no name changed ever took place. Where do I explain this in the petition form?

    – Is the fact my fiancee wasn’t born in the USA (but has lived there for the last 33 years of his life an issue?

    – We communicate mainly via FaceTime. We talk everyday for hours on end. We watch videos, listen to music, shop, visit family and friends this way etc. But FaceTime history only goes back 1 month. And I only started screenshooting since last August (that’s when we got engaged). We spoke to Apple but the aren’t able to provide us with archives conversation times and duration either. What shall we do?

    – We have known each other for 19 months but became an official couple in August 2018. Is the I-129f better option for us then getting married in the UK and filling a Spousal Visa?

    I am a lawyer having two Countries qualification (India and UK)

    I have offices in India and UK. Now I want to open an office in USA(intellectual property services) under L1 catagory. Do I have to submit the lease deed of the rental premises along with I 129 or r use one of the room in my son’s house who is a green card holder in the USA as my office premises? If answer is yes I will be producing the lease deed of my son but the lease deed will be on my son’s name. If no I need to look for rental premises? Please clarify,

      You’ve mistaken the I-129F to the I-129. This website is dedicated to the I-129F and Fiance K-1 visa process not the I-129 and related visas. I’m afraid I can’t help you with your questions.

      I’m assuming you’re the petitioner. You must disclose all addresses you’ve lived in for the last 5 years whether or not they were ever official.

    they approved my 129f k1 last august 8..and they say i need to bring the approved 129f to the embassy once i get my interview schedule..where did i get my approved 129f..they will mail it to mya addres or by email?

      The approved I-129F I-797 is mailed to the US Petitioner. If you were approved recently, you will get a copy soon. It’s also recommended to bring the I-129F to the interview. Please wait a few more weeks before you call up the USCIS and inquire.

    hello good day to you. i am confused a little with the mailing and physical address… my current physical and mailing address is the same but i need to input a physical address 2 and 3 since i only live in my current address for 3 years only… so where do i input my physical address 2 in 11.a to 12.b? should i leave 9.a to 10.b blank since its the same as my mailing address? i will make an extra sheet for the physical address 3.

    should i write N/a to blank spaces or leave them just blank…

      If your address for mailing and physical is the same, then field 9.a will be automatically left blank.
      You will continue entries from 11.a onward. If you need more space to make up the 5 years, you will put it in Part 8 additional information.

    Question 38 on I-129F says if the beneficiary in the USA if yes answer the following questions, . But you read the information instructions. it want s you to list the the last time you have been to america with all the details. My beneficiary was here in Dec 2017 so she is not currently here, do I follow the instructions that ask for the last time or follow the instructions on the I-129 form that do no ask that particular question, but another. thanks

      For your specific question: if she’s currently not here, then leave the question 38 blank. Attach a copy of the i-94 in your paperwork to show history of travel.

      Thanks for stopping by to VisaTutor. The application will take as long as it needs to for you to complete the paperwork and submit it to the USCIS. If you’re prepared with paperwork, then it’ll be quick to gather documents and mail it out. If you’re just starting, then it may take a few days for you to prepare everything.

    Hey Prem, my question for the form is for Part 8. additional information. It says to sign and date each sheet. I’m just confused if i sign on page 13 where the additional info is or do i sign and date on the pages where i needed to add the info on. I just want to make sure i sign in the correct place.       Hello Tatiana,
      The sign and date doesn’t mean sign and date part 8 copies. It means if you choose to submit a separate sheet of paper (rather than part 8 copies) for any additional information, then those pages you must sign and date. Does that make sense?

    Hi, i have a couple of questions. 1. My fiance is from Thailand her real dad has nothing to do with her and she doesn’t have any of the information that the 129f is asking for. What should I do in this case? 2. She has a son but she isn’t bringing him to the us when we marry he wants to stay with her step dad. do I still need his information? 3. does she need to sign the letter of how we met? 4. I previously had a k1 visa fiance not long ago that was approved and I brought her and her daughter here….it didn’t workout so I sent her home. Will this be a problem and how do I answer those questions in that section. its kind of confusing.

      1. This is one of those questions I put as a ‘technical problem’ of the I-129F. What to do if parent’s information is unknown. See the full article here: https://www.visatutor.com/form-i-129f-petition-mistakes/ what’s the answer? well I would advise writing “unknown” and seeing their response.
      2. Yes, even if the minor isn’t traveling, you still input their information in the I-129F.
      3. She doesn’t need to sign a letter of when you met. She needs to sign a letter of intent to marry. This is submitted along with your I-129F packet. See here: https://www.visatutor.com/i-129f-evidence-of-intent-to-marry/
      4. You need to be aware of the multiple filer requirement. Was the last k1 situation within the last 2 years? is this your 2nd or third k-1 petition? the answer will dictate what you need to do in terms of waivers.
