Steps after I-129F Fiance Visa petition approval

What happens after your Fiance visa case (I-129F) is approved

.

Approval of your Fiance visa petition (I-129F) is just half the journey. Take a deep breath. Here’s how you prepare for the final K-1 visa interview…

.

USCIS notification of online case status and I-797 letter indicate your I-129f fiance visa petition was approved

Nothing compares to the feeling when your Fiance visa petition (I-129F) is approved. It means you’re one step closer to being with your fiance. The USCIS has given their  “O.K.” for you to apply for a K-1 visa.

While excitedly looking at that (I-797) letter in your hands now, are you picturing your fiance landing at the airport now? you standing there with flowers to greet him or her?

That day isn’t far away. Want to make sure that all comes true? (see what happens when you file your I-129F to the USCIS. What do they do with your forms?)

.

Steps after I-129F approval

After an I-129F petition approval, there are still 2 major steps remaining. Let’s walk through them step by step. Because it’s important to get them right otherwise, instead of a quick, painless approval — you’re going to see major delays or denial.

Let’s see an overview at the process after your I-129F petition is approved. Here are the three main steps:

.

  • (1) USCIS forwards approved Fiance visa Petition. The USCIS reviews, processes and validates your I-129F petition for an Alien Fiance. After all RFE issues have been dealt with, they approve your case. It’s then sent to the National Visa Center (NVC, still in the US) for processing.
    .
  • (2) NVC Processes Case. The NVC performs background checks and assigns a case number. They send your case overseas to the selected US Consulate with all your case details.
    .
  • (3) US Consulate/Embassy processes case. This Consulate, Post or Embassy performs the final processing, criminal checks and interview before a K-1 visa is granted. This is where it really counts. The “final exam” before you’re approved.

.

After approval of I-129F by the USCIS

So, let’s go back and look at the first step. Following several months of waiting (and feeling like they forgot about you), the USCIS finally informs you that they’ve approved your I-129F Fiance visa petition.

Depending on your preferences, you get notified in different ways. Then they immediately forward your approved case to the National Visa Center (NVC).

.

  • Email, text message. You’re alerted in your email inbox or by text message. If you choose case status updates, the USCIS informs you of a “post decision activity”. In it, it says that the USCIS approved your fiance visa petition.
    .

The USCIS alerts you of approval with email I-129F "post decision activity"

.

  • Mail. You’re mailed an approval Notice of Action I-797 (NOA) with details of your fiance visa petition. The rest of the letter describes how the case is forwarded to the National Visa Center (NVC). Tip: keep this notice safe, you’ll need it when you file the Adjustment of Status (I-485) after marriage.
    .

An I-129F approval is not a K-1 visa approval

Before we get too far ahead, let’s cover an important clarification. Getting your petition approved by the USCIS doesn’t mean your fiance already has the K-1 visa. These are two very different things.

The petition approval is only half the journey. It means your case has being accepted for K-1 visa eligibility. Honestly, this was the “easy” part.

The remainder of the K-1 visa process involves security checks and documents of the foreign beneficiary. The results of which gets decided at the visa interview at the Consulate. That’s the “tough” part.

So, let’s get back to the process. What happens when your case is completed by the USCIS and it’s received by the NVC?

.

The National Visa Center (NVC) processes case

following uscis approval, the nvc reviews and processes the I-129f petitionThis NVC reviews your case following approval of the I-129F. Their main job is to give a fresh look to your case, perform background checks, input your details into the Department of State’s database, and finally assign you a case number.

You’re not actively required to do anything during the entire NVC process.

It’s not glorious and unfortunately that’s why petitioners don’t follow much through this process. That’s a huge mistake.

It’s very important for you to keep track and make sure your case is in and out of the NVC in a timely fashion.

.

What the NVC does

  1. 1. Receives and reviews your case
  2. 2. Assigns a case #
  3. 3. Performs background checks (yet, again)
  4. 4. Forwards your packet to a US Embassy overseas where your fiance has an interview
  5. 5. Mails you an approval notice that your case has been sent abroad

.

Your duty is to follow up with the NVC. Be warned that many times entire petitions are “lost” either in transit or at the NVC. Don’t risk waiting several months to realize something is wrong.

.

The US Embassy processes case

At this point, your approved I-129F petition makes your foreign fiance eligible to apply for a K-1 visa.

The final leg of the Fiance K-1 visa journey is the Consulate phase. The Consulate repeats much of the same process in terms of background checks and eligibility verification. However, they’re much more in-depth.

.

How the US Embassy processes your K-1 case

  1. 1. Receives and Processes. The embassy receives your case, reviews it and performs even more security checks. Your name and your fiance’s name are matched against databases. When all is complete, they take the next step.
    .
  1. 2. Send K-1 visa packet. They mail out (or email) the K-1 visa packet to the beneficiary fiance. Your foreign fiance is invited to apply for the K-1. The packet contain instructions for the steps to take. At this point it becomes a K-1 application (not an I-129F anymore).
    .

  1. 3. The foreign beneficiary collects all required documents and applies for a K-1 visa, including:

    .

    1. ✦ Supporting documents (Passport, birth certificates, etc.)
    2. ✦ DS-160 (filed online)
    3. ✦ Police Clearance
    4. ✦ Medical Exam Report
    5. ✦ Affidavit of Support (I-134)
    6. ✦ Proof of Relationship
    7. ✦ Visa payment receipt
    8. ✦ Much more…depending on your situation (for example, divorce documents).
      .
  1. 4. Schedule interview. When you’re done gathering paperwork, you schedule an interview.  This is the dreaded K-1 visa interview. Where you’re face to face with someone who decides your fate. The beneficiary gets interviewed with questions regarding eligibility and relationship. Any and all criminal history (petitioner’s) is discussed.
    .
  1. 5. K-1 visa approval or denial. The officer makes a decision on the K-1 visa application (approval or denial). All documents will be considered and your bona fide relationship evaluated.

.

If everything is in order, the visa application is approved. In the following days, you receive a visa packet with your passport/visa and sealed medical exam results. Your fiance can literally take the next flight to the US.

If there is a problem in the interview, there can be denials. We don’t want that. Because a denial means you repeat the entire process — totally starting from scratch: months of more agonizing waiting, fees, and another interview.

And worse, no guarantee you’ll get approved next time. Many times, the same problems get couples denied the second time.

.

How to get a K-1 visa approval

Consider the K-1 interview similar to a college final exam. You’ve studied all year for this one chance to graduate. You should go in there 100% confident that you’re going to be approved. You know how much it means to both of you.

Now, I have to tell you some bad news. Denial rates have gotten more frequent over the years due to “extreme vetting” and tighter immigration policies. The K-1 visa is not “easy” as it used to be and definitely not quick anymore.

Professionals, lawyers or anyone else cannot pick up the phone and get you an approval. You really have to earn this yourself by virtue of documents and a genuine relationship. Even one missing document can be an excuse for a delay/denial.

.

the CEAC status reads "issued" when your K-1 visa is approved by the consulate

.

Take the lead and make sure you get approved. All my readers agree that my step-by-step online tutorial  helped them the most. Where you go at your own pace in a guide that holds your hand through each step. What to do, how to gather documents, how to prepare for the interview and pass without a problem.

No guessing, no confusion. Just plain-English steps to follow even if you have red flags (you know… age difference, quick relationship, etc.). It’s all based on actual laws and procedures for all countries.

Plus, a ton of insider tips (that I’ve picked up over the years) to boost your chances of a quick, solid approval.

Do you know what USCIS processing center processes the F-1 visa? On their website, they show 6 centers, and they all have very different timelines.

The I129F Instructions PDF states to send it to a location in Texas. The official USCIS website shows a Texas processing center, but because it doe snot give the address, i cannto confirm if it is the same one where the I-129F is to be sent.

The issue I am running into is that if you check processing times for the Texas center, it only shows process times for K3/K4. So I feel like it might not apply to K1?

So, does anyone know which center does the actual 129F process before it gets sent to the NVC?

Sincerely and good luck to all.

Question for you, we’ve made it to the NVC stage, and got the e-mail notifying us that the application was going to the embassy, however, it’s been 7 weeks and we haven’t heard anything yet. I did call the embassy in Moscow and they asked for her passport # and case# which I gave, but they stated that she did not have a profile and could not be found. At this point I am honestly wondering, did they miss something at the NVC? I am afraid if we wait too long, they will say she’s expired. We’ve been working on this for over a year now, granted covid slows things down but still, we should have some answers now wouldn’t you think? What else can we possibly do at this point?

Good day! My NOA did not have any Priority date indicated on it, may we know what it mean? Also, we asked for an update around August and the NVC told us that ‘Our petition is still awaiting data entry into our system’. The NOA is only valid until October 22, 2020 and we’re worried that it will expire soon but they still haven’t given us the Welcome Letter.

    hello prem,
thanks for answering me back,i look at this website and your you tube channel was very helpful, to me according your explain im not required to do anything even my beneficiary, NVC already issue case number to my beneficiary, but NVC choose (another country) for processing interview, not my beneficiary country,my question is will NVC send the
schedule for medical exam and interview to that country my beneficiary live?for example i file I-129F petition and choose turkey because my beneficiary live in turkey till present and born there never traveled outside, but the NVC choose (lebanon) for processing interview because of security situation in my beneficiary country ,.and second things my beneficiary suppose to file (ds-160) by online now? or wait till the case ready right now
my beneficiary case at NVC? thanks again.

    Greetings,

Thank you so much for the guide! I’m happy to say that after 7 months of hard work and patience, our application was accepted and my fiancee has an interview scheduled for May.

The question now is, I’ve yet to submit the i-134 Affidavit of Support form because I don’t know where or how to send it.. I tried looking at the USCIS website, and it said to refer to the specific form I was filing, which would be the i-129f. When I looked at the i-129f instructions, it made no mention of the i-134 or where I should file it. However, as your guide states, my fiancee needs to have it with her for the interview.

Does this mean I can just fill it out (attach supporting documents), and send it to her to print out? I thought my part with the USCIS was over (for now) but I want to make sure we are doing this correctly. Please help!

    Forever Grateful,
    Edson

My U.S. citizen son and his Indonesian-citizen fiance filed for a K-1 visa while living in Australia. They completed the form I-129 listing her physical address as their Australian address (although they listed her mailing address as her parents’ address in Indonesia). They have received the first NOA. They have since moved to Indonesia (he will be returning to the U.S. in a few months).

The question is, how or when do they send notification of her change of physical address? One would assume that this address affects which embassy their petition is ultimately sent to – they want it to be Indonesia, not Australia.

My son did send a letter to USCIS in California but it was returned with instructions to complete form AR-11. This form is ONLY for people who are currently in the U.S.

Appreciate your detailed website and any help you can provide with this question

Also does any one know what the background check entails? is it also on both parties or just the beneficiary?

    Hello,

I am filling out the I-129f for my fiancé. I asked my fiancé to notarize the intent to marry, and also get two witness affidavits from family and friends. He notarized the documents and mailed them to me. The problem is that the documents are in English, however, the notary stamp is in his language, accompanied by a paragraph from the notary basically stating that he is not responsible for the content of the document, and other information about the signees. I know USCIS requires all documents to be translated, and I’m not sure that I can find a translator soon enough. What are my options? Should I have my fiancé resign the documents (without notarizing them) scan them and e-mail them to me? Will USCIS accept scanned documents and signatures? or am I better off translating them?

I just wanted to say thank you. Your emails and website have been incredibly helpful so far. My case is full of red flags. I’m 20 years older than my Dominican fiance. He barely speaks English, I speak only a little more Spanish. We met in June on a trip I was on. I went back in September and we got engaged. I filed my application in October and today I got an email that said my case status had changed. We were approved! I know that’s only the first hurdle but the relief I feel is unbelievable.

So thank you so much for all of the help. Having so much information in one place has been invaluable.

    Hi Prem,
My fiance and I received our NOA2 right before Christmas (great timing!). Since then, about a month later, I received an email from the NVC that our petition was approved and being transferred to the corresponding US Embassy, included was our case number. Once I received the email I went to the CEAC website to check our visa status and to start filling out the DS-160 form (we have not completed it yet). At that time when I check our visa status it said “in transit.” I checked again today and our status changed to “ready.” I want to be excited but I have no idea what this means and I’m still unsure of what to do next. I’ve read that the US embassy will be sending a packet with instructions to my fiance via post, is that correct? How long does it take? What are the next steps? How do I schedule the interview? I can’t find any detailed information on the internet stating what to do from when to US Embassy receives our petition to scheduling the interview.

    Thanks again

My lover and I are in different countries. I am in the US, he resides in England. He has an ESTA., Our plan is for him to come here, to get married and then to file for change of status. Are we going about this the right way? One attorney suggested that I should travel to England and spend a few days there, and obtain “proof” of a bonafide relationship. He and I have been dating long-distance for about 10 months. We are best friends, we care deeply about one another. Another attorney suggested that my lover obtain a B2 visa.

What is the best route for us to take?

    Thank you,

I’m the Petitioner and I have not received any correspondence from the Embassy or NVC since six weeks ago, should contact the NVC or the Embassy to inquire about the status of my case??? Also, my fiance (the beneficiary) changed her address and phone number so I’m worried that if the Embassy try to send her correspondence via mail she may not get it. Will I be notified as well, either by email or mail when NVC or the Embassy make a move? I appreciate you help.

    Hi!
I have a question for you. We are in the process of K1 Visa application from Canada to the US. I had the interview and all went well except one document they require, my police check from my local police department did not include fingerprints, which they require. SO she gave me a letter and said simply mail new certificate and passport to the embassy and they will send out the visa. I noticed my 129F expires in a week and I will have the documents back to them in 3 weeks (processing time for the record checks here). How do we extend the validity of the 129F, the website simply states that the consular officer can. Does that mean that they just do it automatically? I sent an email to the embassy as well letting them know the situation and that the required documents will be along shortly. Any advice?
    Thank you!!!

    Hello,
Om November 19, my fiance went to his interview. The immigration officer told him that I need to come to the interview as well. There is a lot going on with my country now. I wanted to know if the embassy will allow me to have the interview here in the States due to insecurities.

    HI Prem/Cris/team,
We are waiting for our I 129f approval, meantime I was going through DS-160; it required to answer whether I have even been applied for I-140. When i was in USA on spousal (h4) visa; employer of My Ex were applied for I140 FOR HIM (BENEFICIARY WAS HIM – employee based green card) and it was approved ,should i answer as “YES ” for me? in my DS 160?

I am sorry i have to repeat my question as it wasn’t clear at the first time, I really appreciate your response.

    Hi Prem /Chris

You guys have been very helpfull with this whole K1 visa process and I really appreciate your prompt replies.

I was given a NVC case number and my fiance was notified by the NVC that my case was sent to the consulate in my country.about 10 days ago. I have tried calling the consulate but to no avail it is like virtually impossible to get to speak to anyone.

I have seen your steps in the process. However, since I have not received by mail or email anyting from the consulate on the steps to be taken going forward, can I still complete the DS-160 and pay the fees and later set up an interview once I have my police cearance and other documents. I am concerned because the approved petition iexpires in 4 months I have about 3months left.

Look forward to your reply. and once again thank you guys

    Hi
I currently have an open case for K1 visa that has been in process for 2 months. I saw that previous two comments have approved cases and they are waiting on their NVC number. I was just wondering for how long they were waiting on the approval of their case, since it’s recently approved? I have seen that some people got their cases approved in 3 months, but some even less.

Sorry for opening a new thread, it was not letting me reply on their comment!

    Dear Cris

    Thanks for the guidance.

My fiance’s visa got rejected for want of a police clearance from Singapore where she lived briefly about 15 years ago! We are trying to get a police clearance and resubmit for k visa, hopefully she will get it.

I am requesting more clarification on k2 visa for my fiance’s daughter.
My fiance’s daughter is a college junior in India, and has nearly two years for graduation. She wants to complete her graduation before migrating to the US. She turns 21 in June 2020.
I am told that it takes 4-10 months for the green cards to be mailed once status change application is approved So, my fiance’s daughter cannot stay here even if she came now with her mom – or she will miss her junior year (possibly be expelled for absence, who knows). I don’t know if my fiance can apply for her daughter along with her own status change application without the need for her daughter to even come here now.

What is a prudent way for her to get her green card and yet complete her studies in India? Is there one?

    Hi

My fiance and her daughter are set for their K visa interviews on Sep 30.

I am placing a few questions for your guidance.

    1. I had originally submitted for 129F and DS-160 forms when i was living in Boston. I am moving to LA on September 26. Would it be alright for my fiance to fly to LA after getting her K visa? Would that create any problems for her when she lands in the US? Or should she fly to Boston as originally planned, get her immigration cleared, and then fly to LA?

    2. My fiance’s daughter is currently a junior at college in India and hence she cannot move to the US with my fiance. However, the daughter turns 21 in June 2020 and I am told that sponsored children (K2 visa) need to be in the US before their 21st birthday. Can the daughter come to the US with her mother, adjust status and return back to India on K visa? Can she travel again when the green card is approved? Or is it better for the daughter to come here on her own before her 21st birthday and go through her status adjustment and green card application?

    Appreciate your guidance.

It is said to send married certificate but is not clear wheather it should be sent to USCIS office or visa centre. what else should be send with married certificate? And also do we need to apply for green card within 90 days period or we can apply even after that? should there be affidavit of support with green card application?

I just want to say what a great experience it has been to learn from Prem here. My fiance, Rose, had my petition received by USCiS on 04/18/201. It was approved on 07/18/2019, exactly 12 weeks you guys!
It arrived at NVS on 08/09/19 and 11 days later we got her case number and I received email that they were moving it forward to the embassy in Manila!
She has already done her DS-160 online and paid the application fees. We are just waiting for that “READY” notice on the ceac website to make the interview appointment.
This website has been a Godsend and enabled me to assemble a I-129F that flew through the process of approval. Thank you so much Prem!

Thank you so much for your response. It was useful.

I was able to schedule an appointment with US consulate but he earliest available appointment is Oct 3rd – which is exactly a month after my 129f approval expiry date. My 128f approval expires on Sep 3rd.

I have a few questions; appreciate your views here.

    1. The US consulate has given my fiance two separate appointments – first on Sep 14 for VAC appointment, and the second on Oct 3 for Consular interview. They have listed the documents my fiance needs to bring to these interviews – seems like the VAC appointment is less detailed than the consular interview. Is this normal – two separate interviews?

    2. Both the appointments are past the expiration date of my 129F approval. Do i need to seek extension for the approval of 129F petition? If so, who is should i contact? The USCIS in the US or the visa issuing embassy overseas?

Thank you again for the assistance.

My I797 approving my 129f petition states that the approval expires on September 3rd. I am still waiting for K1 visa appointment dates.

Does my fiance have to enter the US before september 3rd?
Do i need to apply for an extension of my 129f approval or is it okay as long as my fiance has a valid k1 visa?

    Appreciate your guidance.

    Here’s the current situation:
    received approval from USCIS 4/26/2019;
    got a case number through NVC;
    used it to query the status;
“Please follow the instructions…..”; seems to indicate they have sent something to my address / email; NOTHING!
    Did not received “instructions”;
    waited “up to six weeks” (actually 8 weeks) and emailed NVC;
    sent an email 10 June to NVC;
    NVC replied “We don’t have a record of receiving your petition” on 27 June;
BOTH USCIS & NVC websites state respectively, “Your Case has been approved” & “Please follow the instructions”: with a NVC case number.

Calling either is useless. Email to and from NVC take weeks: “As of 1-JUL-2019, we are responding to emails received on 10-JUN-2019.” When I do make contact by phone (1 to 2 hour waits), the reply to my question: “it is in administrative review”.

What are they reviewing? The 129F? We haven’t sent NVC anything to be reviewed. How can they review something they state they don’t have a record of. Asking US Representative for help also useless; can’t see the forest for the trees!

    Your comments would be appreciated!

    Sincerely, ART

    Hi Prem,

My question is concerning the I-134. I’ve had mixed messages on this subject and want to do it right.
I do NOT send it with the I-129F petition, is that correct? Once we have an approval and it is closer to the time of the interview, that is the time to send the I-134 to my fiance and he takes that to the interview… do I understand that correctly?

Also, because I volunteer most of my time in Haiti (where my fiance is from) I will not have the financial stability they require to show on that form. I know I can have a joint sponsor, but do I also need to fill out the I-134, or does only my joint sponsor need to fill it out and send that to my fiance? Can all the required documents for that form be emailed to us in Haiti, or will I need to come back to the states and physically take them back with me?

    Thank you in advance!

    Hi Prem,
We have been on a roller coaster since filing for the K1 visa, but now its getting worst. Today make it 15 months since starting the process. We started February 2018, never got an information until January when they asked for proof that we intend to get married which I provided.

Then in February 13, we were approved, exactly 1 year. Anyway we were excited, then the problems began. My fiancee lives in UK on a resident permit, but left to go back home because the visa was going to expired, he didn’t want to over stayed his time, so before he left we communicated with our lawyer and she said no problem, the interview can take place anywhere, just email the new address 10 days prior to leaving the UK which we did, and unfortunately 2 months after he got approved.

The problem is that the case is in UK ready to be interview, but he cannot go back because he has no visa, the NVC has no control over it to ask the UK to redirect it to where we are, and the Jamaica embassy refused to request that the case be sent to them. Now I don’t know what to do. Its 4 months since being approved and there is nothing either embassy will do to help us. The approval notice expired June 12, 2019, what can I do to expedite the process. I send endless emails, I make endless phone calls to the UK embassy, Jamaica embassy and the NVC center and nothing. Please what kind of advice can you give. I am frustrated, my back is against the wall and I have no one to seek advice from

    Frustrated reader.

I even sent them an attachment of 797 and NVC told me they contacted USCIS on my behalf to figure out where my case documents are. it is now over 2 months since USCIS approved my application, but nothing is moving . My approval is valid until 6/19/2019. What’s your advice on my situation.

    Hello prem,
Finally after one year we got our approval for our k1 visa from uscis, now the mail said that the case has been transferred to the nvc and that the nvc will mail us when they transfer the case to the embassy. I’m a little confused because I’m not aware of the steps of the nvc phase and I’m hoping that you can help. When I get the case number what should I do with it? We got the approval on December 4th so it’s almost 10 days ago, I’m about to call them or email them within a week to get my case number but What does the case number do for me? Is it for taking the interview appointment in the embassy? Also until now nobody asked us about the affidavit of support papers and I’m not sure how should I submit them, does my fiancé take this application (I-134) with him to the interview or the nvc will ask us to send it to them before the interview? Also I heard that can I submit this application after he arrives to the us is that true? One last question do you think it’s a good idea that I go with my fiancé to the interview if I’m able to? Our case will be transferred to the American embassy in Cairo Egypt
Sorry for asking too many questions but we waited a whole year for the approval and I don’t wanna do any mistakes we wanna be done and get married
    Thanks in advance

So my fiancé and I have gotten approved for the I-129F form. Our paperwork has made it through to the NVC and then on to the Is Embassy in London. He has already went for his medical exam but they needed permission to obtain his medical records and his doctor is taking forever to send them off. His medical exam was October 29th, 2018. It is currently
December 10th, 2018. We have waited on his doctor to gather the correct paperwork for over a month and our expiration date is the 21st of December 2018. He has since made his interview date, but we are afraid of not being approved at the interview because the lack of medical records his doctor has failed to provide. There is a way that we can get our dead line extended but we have not been assigned a consular at this moment in time. What should we do about this? Is there something we can do? He has called his doctor numerous times about sending the documents off to the Embassy but they haven’t done anything about it. How would we go about getting our expiration date for our approval extended?

We created DS-160 application, but have not submitted it yet and have not schedule the appointment yet. We was waiting for Embassy to send us the K-1 packet, but still have not received it yet.

We just went back to check the status again. It shows following:
20-Nov-2018 Your Case has been returned to the National Visa Center(NVC). Please contact NVC for further information. http:nvc.state.gov/ask. For more information, please visit Travel.State.Gov.

I called NVC, they have not received the case back yet, but they will returned our case back to USCIS once they receive it. We are stuck now. We don’t know what to do. Do you know what should we do now? Just wait for USCIS to contact us? Please advise. Thank you very much!

    Hi Prem,

I just wanted to tell everybody that I finally got my I-129F petition for my finance approved by Immigration! It took almost 8 months, but by using your guides and getting answers to my questions I got it approved without an “RFE.” Thanks so much Prem for your help and your website has excellent information with videos, examples, information, updates, and stories of success stories. Mine has been one of them and anybody out there who is still waiting, remember it took me 8 months, so there is still hope. Now, I am studying his information to help my finance prepare for her interview. It is hard being patient, but well worth it when it gets approved. If I can follow these steps and get mine approved, then so can you. Thanks Prem for all of your help and information provided on this website. I hope my little story will help others with their K1 Visa’s as well.

Greetings to all on this wonderful Journey,

I wish everyone lots of luck. I had never before heard of the k-1 process until I was calling the consulate overseas. I met my fiancé through a family friend and when I met him and got to know him I fell in love like many of you have done with your SO. I filed the K-1 petition in July and after an RFE in March because of lack of my passport photo and letter of intent we were then approved in March. By the time NVC reviewed our forms and the consulate received the hardcopy of the petition from NVC our interview date was the 1st week of May 2018.

So my fiancé goes to his interview and feels confident about each question and response and as well as that we have tons of evidence to back up our relationship. At the conclusion of the interview he asks them, “ Did I pass the interview”? Instead of a response he was handed a 221g yellow form and was left speechless. The Consulate Officer told him that the visa was refused at this time but that they were going to take everything for further review and then get back to him. The CO kept his passport and told him to fill out online where he would like to retrieve his passport when Administrative Processing is over.

Meanwhile in the US, I’m sitting here anxiously at work waiting for his call on FB messenger and after 2-3 hrs I started to feel uneasy. When he told me the type of response that was given at the conclusion of the interview I felt so sick and faint I left work at lightning speed. We talked about what happened as we both felt scared and were trying to fight tears. After speaking to my fiancé I called Prem, the superhero, and he was able to reassure me and told me to keep checking with NVC to see what their updates was over the coming days and to call or e-mail the consulate with reference to our receipt# in the calls and e-mails. My goodness everyone, speaking to Prem really helped me. It was like he threw a bunch of water on a fire. I called the NVC that day and the people on the phone are very sympathetic and understanding the words they used are so comforting I didn’t feel like I was speaking to a complete stranger thousands of miles away from CA. The NVC told me to stay on top of contacting the Consulate for definite answers. From fri-sun I kept emailing the consulate and I tried to get answers for the heck a 221(g) yellow form is, the purpose of not being given clear answers from the CO, if my fiancé passed the interview, ect. I think a total of seven emails went back and forth the next couple days. But in the last e-mail the consulate admitted that he was supposed to pick up not only his passport, but my documents, and his VISA 🙂 and after reading that in the e-mail on the NVC website the status changed to ‘Issued’.

I felt like I had won my life back
    .
So now I am preparing for his soon arrival and our wedding ceremony in July 2018.
I will say this to everyone. Yes the process does cost a bit. I was fortunate that my fiancé paid for his airline tickets, police clearance/medical/visa. I am paying for the wedding and AOS/work permit. Even though I’m on a tight budget and can’t have the wedding of my dreams like many others in this process I’m still at peace because I found my soulmate. Someone I can’t live without and my future only exists with him in my life together in each other’s presence. I never knew that I was ready for marriage until we met.

After our wedding later on when we’ve saved enough we’ll have a small party, take a trip, ect. But my advice to everyone is to stay strong. Keep loving each other and don’t let any negativity about the process get between you and your fiancé. I’m so glad we both were capable of doing so. And for sure, you’ll be approved across the board as well.

P.S. my fiance’s Consulate is in Fiji and wishing all love, approval, and wedding bells.

Hi! I received an email containing my reference case number, that the petition is now at my local US embassy. Also, it mentioned about my upcoming immigrant visa interview. can i now make an appointment schedule at the US embassy using the email letter sent or do i still have to wait for the “physical” letter to arrive?

    Hello,
Our I-129f petition was approved on January 31st and is due to expire on May 31st, we thought it would take long for the Dublin Embassy to send out our visa packet so I visited my fiancee in the U.S. for a few weeks. I have all my documents ready and my medical on the 17th May. They said it takes 7-10 days for the results to come back so I’m estimating May 28th/29th to submit my letter of readiness. Is this OK as everything will be done and ready and submitted before the expiration date or should I apply for an extension? If I need to apply for an extension how do I go about doing that in Ireland?

Any help would be greatly appreciated.

    Thank you.

    Hey there,

my i-129F got approved. I know the medical exam asks about previous incidences of self-harm. My fiance was in a severely battered abusive relationship that ended 6-7 years ago, and due to duress she had cut herself on that one ocassion. She successfilly completed treatment with a Doctor and was discharged accordingly. She will take a letter stating she is of no harm to herself and that she has no mental disorder. I hear that is important for the case officer to see.

Have you seen/heard of these issues in the medical phase with other applicants? I am told that so long as she is in good health today and has supporting documentation, she should be just fine.

That is the only ? on her side of the coin. I have a single misdemeanor possession of marijuana criminal conviction. My petition got through, and I know they look for more serious crimes.

Any chance her medical issue and my one blemish on my record can cause grounds for denial? My understanding is that they want to make sure it is a bonafide relationship (which we have mountains of evidence of) as well as that the Beneficiary won’t be a harm to the public or a public charge (which she isn’t she will have medical and professional character references).

    Thanks!

I read that after 50-75 days you need to call and do a verbal check on your case status. Is this true?

They have lost my case after the approval, so I waited another 4 months for the NVC to get it. Now it is 10 days they got it, but we still have no case number.

    Hello ,

My case was approved in November 2017 and I have no update ever since. I contacted the USCIS and the NVC hundred times and still nothing.
I call them on weekly basis and they tell me to wait a month for the answer, I do wait but again nothing happens.
In February the NCV said they contacted the USCIS and USCIS said that they have emailed the notice in February 12, but after a month I call the USCIS and they tell me they haven’t sent anything to NVC yet.

    Hello,

My issue was that after USCIS approved my case I didn’t have any update after 2.5 month. I contacted NVC as advised here, and they had no idea where my case was. They didn’t even get it. They asked to send them the approval notice and they will notify me in 15 days time.

Is this just delay, or something might be wrong.

    Thanks,
    An
